Terms of Service
These Terms of Service govern use of the NearNow marketplace by guests and independent providers.
Marketplace terms
- NearNow connects guests with independent local providers.
- Guests do not create accounts in the current public product and may browse and request bookings as guests.
- Providers create accounts, manage listings, and subscribe to the Provider Plan.
Provider responsibility
- Providers set their own prices, availability, and service details.
- Providers are not employees of NearNow.
- Providers are responsible for required licenses, certifications, insurance, taxes, and compliance with applicable law.
Payments
NearNow is not the merchant of record for guest appointment payments. Guests pay providers directly in person.
NearNow charges providers for the monthly Provider Plan through Stripe on the web or StoreKit on iOS, depending on platform.
Acceptable use
- Do not misuse secure booking links, provider accounts, billing features, or administrative tools.
- Do not submit false, abusive, unlawful, or fraudulent booking requests.
Text message terms
By opting in to NearNow text messages, you agree to receive transactional SMS messages related to your bookings and account activity. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe and HELP for assistance. Consent to receive SMS messages is not a condition of purchase or use of NearNow.
An SMS opt-out applies to SMS messaging. Essential service information may still be provided through other channels where available. Mobile carriers do not guarantee message delivery. You are responsible for providing and maintaining an accurate mobile number.
Disputes and governing law
The intended governing law is Nevada.
The intended dispute mechanism is binding arbitration, subject to applicable law and any legally required exceptions.
